DISCLAIMER – Exclusive Global Visas (Pty) Ltd

This Disclaimer, Terms of Service and Privacy Policy (“Disclaimer”) governs all services provided by Exclusive Global Visas (Pty) Ltd (“Exclusive Global Visas”, “EGV”, “we”, “our”, “us”) to any applicant, customer, company, representative or other person making use of our services (“Customer”, “Applicant”, “you” or “your”).

By requesting our services, accepting a quotation, making payment, submitting documents (whether electronically, by courier or in person), permitting another person to submit documents on your behalf, or instructing us to proceed with your application, you acknowledge that you have read, understood and accepted this Disclaimer in its entirety.

  1. OUR SERVICES

1.1 Exclusive Global Visas provides administrative visa facilitation and courier services.

1.2 Our role is limited to assisting with the preparation, submission, collection and return of visa-related documentation where requested.

1.3 We are not an Embassy, Consulate, High Commission, Visa Application Centre or Government Authority.

1.4 We do not issue visas.

1.5 We have no authority to approve, reject, expedite or influence visa applications.

1.6 The decision to grant, refuse, cancel or amend any visa remains solely with the relevant Embassy, Consulate, High Commission or Government Authority.

1.7 We do not provide legal, immigration, tax or professional advice.

1.8 Information supplied by us is intended solely as general procedural guidance based upon publicly available information and our experience.

  1. CUSTOMER RESPONSIBILITIES
The Customer is solely responsible for:
  • Ensuring all information supplied is truthful, accurate and complete;
  • Ensuring supporting documents are genuine and valid;
  • Checking the accuracy of completed application forms before submission;
  • Complying with all Embassy requirements;
  • Attending biometric appointments;
  • Complying with all immigration laws of the destination country;
  • Ensuring passports remain valid;
  • Ensuring visas issued are correct before travel.
 

Any errors, omissions or inaccuracies that remain after Customer approval shall be the sole responsibility of the Customer.

  1. ADVISORY INFORMATION

3.1 Embassy requirements change regularly without notice.

3.2 Processing times published by Embassies are estimates only.

3.3 Information provided by Exclusive Global Visas is based upon current publicly available guidance and previous experience.

3.4 We cannot guarantee that Embassy officials will accept documentation merely because similar documentation has previously been accepted.

3.5 Any recommendations, suggestions or guidance provided outside mandatory Embassy requirements are supplied in good faith and remain advisory only.

3.6 The Customer accepts all risks associated with relying upon such guidance.

  1. ACCEPTANCE OF SERVICES

By requesting our services or submitting documentation, the Customer agrees to:

  • Engage Exclusive Global Visas;
  • Pay all applicable fees;
  • Comply with these Terms and Conditions;
  • Authorize us to submit and collect documentation on their behalf where applicable;
  • Authorize communication with Embassies, Consulates, Visa Centre’s and Government Authorities where necessary.
 
  1. FEES AND PAYMENT

5.1 All service fees, courier charges, Embassy fees and third-party charges are payable in accordance with our quotation or invoice.

5.2 Unless otherwise agreed, payment must be received before documents are submitted.

5.3 Service fees become non-refundable once work has commenced.

5.4 Embassy fees and courier fees remain non-refundable irrespective of visa outcome.

5.5 We reserve the right to charge additional fees for:

  • Urgent requests; emergency applications; additional submissions; additional collections; late requests; out-of-scope services.
 

5.6 We reserve the right to suspend services until outstanding amounts have been paid.

5.7 We may retain passports or documentation lawfully in our possession until outstanding invoices have been settled where permitted by law or agreement.

  1. CANCELLATIONS
  • Cancellation after work has commenced does not entitle the Customer to a refund of service fees.
  • Third-party costs already incurred remain payable.
 
  1. NO GUARANTEE

Exclusive Global Visas makes no warranty or guarantee regarding:

  • Visa approval; Processing times; Appointment availability; Travel dates; Visa duration; visa validity; Embassy decisions.
 
  1. LIMITATION OF LIABILITY

To the fullest extent permitted by South African law, Exclusive Global Visas shall not be liable for any direct or indirect loss arising from:

  • Visa refusals; visa cancellations;
  • Embassy processing delays; appointment shortages;
  • Government policy changes;
  • Courier delays;
  • Incorrect information supplied by the Customer; fraudulent documentation; third-party criminal conduct;
  • Airline schedule changes; missed flights; accommodation losses; tour cancellations;
  • Business interruption; lost profits; loss of opportunity;
  • Consequential damages; deportation; refusal of entry; quarantine requirements; border closures;
  • Force majeure events.
 

Our maximum liability shall never exceed the total service fees paid directly to Exclusive Global Visas.

  1. THIRD-PARTY SERVICES

We rely upon numerous independent third parties including:

  • Embassies / Consulates / High Commissions; Visa Application Centre’s; courier companies; payment providers.
  • We are not responsible for their actions, omissions, delays, negligence, system failures or decisions.
 
  1. ELECTRONIC COMMUNICATION

The Customer accepts that communication may occur via:

  • Email; WhatsApp; telephone; SMS; online portals; electronic document sharing systems.
  • Electronic communication carries inherent security risks including unauthorized interception, corruption and delay.

Exclusive Global Visas shall not be liable for losses arising from electronic communication where reasonable security measures have been implemented.

  1. CONFIDENTIAL DOCUMENTS

All documentation received shall be treated as confidential.

Documents will only be accessed, copied, transmitted or stored where reasonably necessary to perform the requested services or where required by law.

  1. PROTECTION OF PERSONAL INFORMATION (POPIA)

Exclusive Global Visas complies with the Protection of Personal Information Act, 4 of 2013 (“POPIA”).

12.1 Information We Collect

We may collect:

  • Names; passport information; identity numbers; contact details; addresses; employment information; financial information; travel itineraries; visas; supporting documentation; biometric appointment information; correspondence; photographs; signatures; any information required for immigration processing.
 

12.2 Purpose of Processing

Your information is processed solely for purposes including visa facilitation for :

  • Appointment booking; document submission; document collection; courier arrangements; customer communication; invoicing; payment processing; legal compliance; record keeping; quality assurance; fraud prevention.
 

12.3 Sharing Information

The Customer expressly authorizes Exclusive Global Visas to disclose personal information where reasonably necessary to:

  • Embassies / Consulates / High Commissions; Visa Application Centres; courier companies; Government Authorities; payment processors; any service provider necessary to complete the requested service.
  • Once information has lawfully been disclosed to third parties, Exclusive Global Visas cannot control how those third parties process such information.
 

12.4 Consent

By using our services, the Customer expressly consents to the collection, storage, use and disclosure of personal information as described in this Disclaimer.

Where required by law, consent may be withdrawn, subject to legal or contractual obligations that require continued processing.

12.5 Accuracy

The Customer warrants that all personal information supplied is accurate, complete and up to date.

12.6 Retention

Personal information will be retained only for as long as reasonably necessary to:

  • Complete our services; comply with legal obligations; resolve disputes; enforce agreements; maintain business records.
  • After this period, information will be securely destroyed or anonymized where appropriate.
 

12.7 Security

Exclusive Global Visas implements reasonable technical and organizational measures designed to safeguard personal information against:

  • Unauthorized access; loss; misuse; alteration; destruction; unlawful disclosure.
  • No electronic storage system can be guaranteed completely secure.
 

12.8 Customer Rights

Subject to applicable law, Customers may request:

  • Access to their personal information; correction of inaccurate information; deletion where legally permissible; objection to certain processing; withdrawal of consent where applicable.

Requests should be submitted in writing.

12.9 Cookies and Website

Where our website uses cookies or similar technologies, these may be used for:

  • Website functionality; security; analytics; performance improvement.
  • Users may manage cookies through their browser settings.

  1. RECORDINGS

Telephone calls, emails and electronic communications may be monitored or retained for:

  • Training; quality assurance; fraud prevention; dispute resolution; legal compliance.
 
  1. INTELLECTUAL PROPERTY

All documentation, templates, forms, correspondence and materials prepared by Exclusive Global Visas remain our intellectual property unless otherwise agreed.

  1. FORCE MAJEURE

Exclusive Global Visas shall not be liable for delays or failure caused by circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters; pandemics; strikes; war; civil unrest; government action; system failures; power outages; internet failures; Embassy closures.
 
  1. GOVERNING LAW

This Disclaimer shall be governed by the laws of the Republic of South Africa.

  1. DISPUTE RESOLUTION

The parties shall first attempt to resolve disputes amicably.

Should this fail, disputes shall be subject to the jurisdiction of the competent courts of South Africa unless otherwise agreed in writing.

  1. SEVERABILITY

If any provision of this Disclaimer is declared invalid or unenforceable, the remaining provisions shall remain in full force and effect.

  1. AMENDMENTS

Exclusive Global Visas reserves the right to amend this Disclaimer at any time.

The latest version shall apply from the date of publication or notification.

  1. ENTIRE AGREEMENT

This Disclaimer constitutes the entire agreement relating to the services provided by Exclusive Global Visas unless superseded by a written agreement signed by both parties.

ACKNOWLEDGEMENT

By requesting our services, submitting documentation, instructing us to act on your behalf or making payment, you confirm that:

  • You have read and understood this Disclaimer;
  • You agree to be bound by its terms;
  • You consent to the processing of your personal information in accordance with POPIA;
  • You understand that Exclusive Global Visas acts solely as a visa facilitation and courier service and cannot guarantee the outcome of any visa application.
